Couples who are not registered for marriage but live together have some rights under the law, as follows:
- Right to parental custody Couples who are not registered for marriage but have children together have the right to parental custody. The party who has the right to parental custody is the party who primarily raised the child or the party who has the right to parental custody under the parents’ will.
- Right to support Couples who are not registered for marriage but have children together have the right to support the child. The party who has the right to support the child is the party who primarily raised the child or the party who has the right to support under the parents’ will.
- Right to inheritance Couples who are not registered for marriage but have lived together for a long time until they are known to society have the right to leave an inheritance to the other party. The other party can claim the inheritance under the Civil and Commercial Code.
- Right to sue for justice Couples who are not registered for marriage but live together, if one party commits an act that is a tort against the other party, the other party can sue for justice under the Civil and Commercial Code.
In addition to the above rights, couples who are not registered for marriage but live together also have additional rights, depending on the agreement between them, such as the right to take care of joint property, the right to access the other party’s personal information, the right to receive benefits from government agencies, etc.
In the event that a couple is not registered for marriage but lives together and breaks up, the party who is affected by the other party’s actions can claim their rights under the law. However, the rights of couples who are not registered for marriage are more limited than the rights of married couples.Therefore, couples who are not registered for marriage should have an agreement between them to clearly define their rights and should consult a lawyer for advice on their rights.
